Every child with SEND deserves an EHCP that is accurate, person-centred and legally sound. As local authorities across England face mounting pressure to draft more plans in less time, general-purpose AI assistants such as Microsoft Copilot have entered the conversation. They promise faster text generation and reduced administrative burden, and for routine office tasks, they can deliver on that promise.
EHCP drafting, however, is not a routine office task it requires specialist knowledge. The statutory process governed by the Children and Families Act 2014 and the SEND Code of Practice, requiring evidence-led content drawn from multiple professional reports, family views and lived experience.
The question for SEND leaders is not whether AI can help, but whether the AI you choose is built for the complexity and accountability that EHCP drafting demands.
General-purpose AI assistants such as Copilot are designed to handle a broad range of tasks: summarising emails, drafting meeting agendas, rephrasing paragraphs. They are effective productivity tools for everyday administration. When applied to EHCP drafting, though, they hit clear limits.
An EHCP is a legal document. Sections B through I must describe needs, outcomes and provision with the specificity required by the SEND Code of Practice.
General-purpose AI has no built-in awareness of these statutory sections, no understanding of how to link a child's assessed needs to quantified provision, and no mechanism to flag gaps or contradictions between professional reports.
As CYP Now reported in 2025, versions of Copilot typically available to local authorities offer limited control over how the system behaves, including how likely it is to produce inaccurate or biased outputs. Where caseworkers rely on generic AI, the quality of the output depends almost entirely on the quality of the prompt, and that places a significant burden on already stretched SEND teams.
Crucially, general-purpose AI cannot trace its generated text back to the source document. If a plan is challenged at tribunal, demonstrating how each statement was informed by professional advice becomes far more difficult when the drafting tool does not maintain an audit trail.
In the short term, using Copilot or a similar assistant to rephrase content or speed up basic drafting may appear low-risk. Over time, however, the compliance gap widens.
SEND legislation evolves. The 2026 Schools White Paper introduced proposals for Individual Support Plans, and Ofsted and CQC inspection frameworks continue to raise expectations around plan quality and consistency.
A general-purpose AI tool updates on its own schedule, driven by its commercial product roadmap rather than changes in SEND statute or inspection practice. It does not adapt when a new DfE guidance note changes how Section E outcomes should be written, or when a local area revises its EHCP template.
For local authorities, this creates a growing maintenance burden. Staff must manually check every AI-generated section against current guidance, build their own prompt libraries, and manage version control for locally developed workflows. Without dedicated EHCP quality assurance processes, inconsistencies accumulate across the caseload, often surfacing only at inspection or tribunal.
Data governance presents a parallel concern. EHCP records contain special category data under UK GDPR Article 9, including health, disability and safeguarding information.
General-purpose AI tools were not specifically designed for this level of sensitivity. Purpose-built systems with ISO 27001 certification, UK data residency and clear policies on training data offer a more defensible position when handling children's personal information at scale.

General-purpose AI will continue to improve, and it has a role in many areas of local authority administration. For EHCP drafting, though, the requirements are specific: statutory alignment, multi-document evidence synthesis, template matching, quality feedback and a clear audit trail. These are not features that a general-purpose tool can be prompted into reliably.
Authorities that invest in purpose-built AI now are building sustainable workflows that will adapt as SEND legislation and inspection frameworks evolve. They are also building capacity: when caseworkers spend less time on manual drafting and more time on quality assurance, co-production and direct engagement with families, the plans themselves become more person-centred and the outcomes for children improve.
